mellow celebration at seattle's space needle? pot smokers lit up like it was new year's eve. new voter approved initiative went into effect midnight. this pot party technically, is illegal. wz's law bans smoking pot in public places. for now the seattle police department is turning a blind eye. this notice was sent to all officers last night. until further notice officers shall not take any enforcement action, other than to issue a verbal warning, for a violation of initiative 502. miguel marquez is in seattle. you were there at midnight for the big party, when the law went into effect. what was it like? >> reporter: well, it was a lot of pot being smoked. i think i must have a contact high from all of that. it was one of many, many parties across the state last night as proponents of this law celebrate the first time that pot is legal here. it's the first step in a very long process. ♪ because i got high >> reporter: the moment recreational pot, anything less than an ounce no longer illegal in washington state. >> it's amazing. i'm not a criminal anymore. i can't go to jail for smal

karlinsky, abc news, seattle. >> what a story. >>> now, to the latest twist in the controversial utah custody battle. a baby girl was put up for adoption without her soldier father's knowledge or consent. a judge ordered the girl returned to her father. and now, the mother is speaking out in an abc news exclusive. amy robach is here with the latest on this controversial story. >> reporter: good morning to you. this bitter battle over a 21-month-old little girl, between her adoptive parents and the biological father, has grown more complicated. the girl's birth mother is speaking out to abc news. tira bland says no matter who has custody of her daughter, she is still her mother. and she still loves her. >> her well-being is all that matters to me. i want to see her successful. i want to see her in a home, a good home. >> reporter: but the question of just who provides that home is now at the center of a contentious custody battle. bland's ex-husband, terry achane, a sergeant in the army, said bland put his daughter up for adoption without his knowledge in 2010. when he learned that the

by voters last month, and took effect at midnight. in seattle, about 100 people marked the occasion by smoking joints beneath the city's iconic space needle. technically, doing that in public remains against the law. marijuana is still illegal under federal law. but the justice department has not said if it will try to block the washington state law or a similar statute in colorado. same-sex marriage also became legal in washington state today, and in maryland. gay and lesbian couples in both states began picking up marriage licenses. those in washington state have to wait three days to be married. same-sex ddings in maryland will begin on january first. maine will legalize the practice on december 29. the three states are the first to approve same-sex marriage by popular vote. in economic news, new jobless claims fell sharply last week, after a temporary spike in the wake of hurricane sandy. and on wall street, stocks managed modest gains today. the dow jones industrial average added 39 points to close at 1,374. the nasdaq rose 15 points to close at 2,989. the u.s. senate has overw

for recreational use. cnn's miguel marquez is joining us from see yat -- seattle. still some roadblocks, but what's the latest? >> reporter: some roadblocks indeed. you can have pot right now, but you can't go out and buy it. you still have to go to the black market. but in a year's time if everything goes the way it's supposed to, washington state will be a haven for pot. in the war on drugs, the government surrenders to marijuana users here in washington state. up to an ounce now legal for anyone over 21. >> we got that weed growing. we ain't worried about no police. we're out here living like tupac, baby. all eyes on the city cause we got it going on. >> reporter: this is the moment when marijuana became legal to possess at least under one ounce here in washington state. several dozen people, perhaps 100 people have showed up here at the space needle to smoke up and celebrate. including this guy. >> america, freedom! >> reporter: rick steves of tv travel fame co-sponsored pot initiative here saying it's about decriminalizing marijuana and freeing up government to focus on more important things

oregon and also up in the seattle and the coast of washington state. now tomorrow we are actually going to see even heavier rain start to move in. we have already had reports of about 8 to 10 inches of rainfall already from the past few storms we've already seen. but we've also gotten reports of wind gusts up to 60 to more than 80-mile-per-hour. and we're going to see more of the same if not a little more intense as we go into sunday morning. additional rainfall totals on top of the 8 to 10 inches on the ground could be an additional 5 to 6, 7 inches of rainfall out of what we'll see tomorrow morning. we have the series of storms moving into the west coast. then it's a totally different story right in the middle of the country. we're also talking about record-break heat today. down into dallas and also into san antonio where temperatures should get into the upper 70s and lower 80s. that's about 20 degrees warmer than average for this first day of december. the only cool spot really is in the northeast where temperatures today will only be in the 40s and 50s. we should tap out closer to
